ACCOMMODATION CONTRACT
1. OBJECT. By virtue of this contract, UT HOTEL LAS ISLAS - NIT 901115948, hereinafter referred to as HOTEL LAS ISLAS or THE HOTEL, will provide accommodation to the GUEST in the room and its accessories, in exchange for a price, under the conditions noted in the Hotel Registration Card and/or the reservation. Under no circumstances will the term exceed 30 consecutive days.
1.1. The room will be the one indicated in the Hotel Registration Card. The HOTEL may change the room if the guest accepts it and it is a room of equal or better conditions, or due to a case of force majeure.
1.2. Check-in time is from 3:00 PM on the day of arrival, and check-out time is until 1:00 PM on the day of departure. The time period between check-in and check-out corresponds to the hotel day. Early check-in or late check-out is subject to availability, and the
GUEST must pay the corresponding charge.
1.3. Accommodation will be provided regardless of the actual time the
GUEST stays in the room. Partial use requires full payment of the rate.
1.4. The provision of the services covered by this contract and any additional services offered by the hotel is subject to availability and the hours, shifts, or physical availability of supplies, goods, facilities, or spaces for such services.
2. PRICE.
2.1. The price of this contract corresponds to the nightly fee the
GUEST is required to pay, which is the amount indicated in the Hotel Registration Card and corresponds to the reservation made, all of which will be described in the corresponding invoice, unless the reservation was made and paid through a travel agency, in which case the rate will be the one agreed directly with the agency.
2.2. The
GUEST must also pay for all charges related to food, drinks, laundry, and generally all other services generated during their stay that they choose to charge to their account.
2.3. The
GUEST declares that they have been informed of the rates, fees, and prices for rooms per night.
2.4. Failure to pay the agreed amount will result in interest charges for late payment at the maximum rate allowed by law.
3. CUSTODY OF MONEY AND VALUABLES.
Valuables such as jewelry, cameras, money, computers, and cell phones must be reported and declared at Reception at the time of check-in so that they may be deposited at HOTEL LAS ISLAS, should the
GUEST voluntarily decide to do so. For this purpose, HOTEL LAS ISLAS has civil liability insurance, which coverage requires prior declaration by the guest. If the
GUEST does not make such a declaration and does not deposit the goods, they will assume full responsibility for their valuable items that remain in the room, safe, or hotel service areas, as the hotel will not assume any responsibility for loss or damage, and the insurance will not apply.
4. OBLIGATIONS.
4.1. HOTEL’S OBLIGATIONS.
4.1.1. Provide the service covered by the contract.
4.1.2. Attend, receive, process, and respond to any suggestions, complaints, or claims made by the guest.
4.1.3. Safeguard any money and valuables entrusted to it by the guest for safekeeping, in accordance with Article 1195 of the Commercial Code.
4.1.4. Other obligations established by law.
4.2. GUEST’S OBLIGATIONS.
4.2.1. Identify themselves to check-in with an appropriate identity document, presenting their national ID if Colombian or their passport or applicable document if foreign. For minors, a valid identification document must be presented.
4.2.2. Pay for the accommodation and applicable taxes.
4.2.3. Pay for all charges incurred by the
GUEST during their stay.
4.2.4. Maintain proper behavior and dress appropriately.
4.2.5. Be liable for minor negligence of their obligations and those of their companions or guests.
4.2.6. Register all companions or guests in the hotel reception who will be going to their room and pay the corresponding fee for each.
4.2.7. Respect the number of people per room.
4.2.8. The
GUEST acknowledges that participating in sports, physical exercises, operating vessels or vehicles, using instruments, and any activity that involves risk or may be considered dangerous is at their own discretion and exclusive responsibility, implying that the
GUEST has the skills and knowledge necessary to assume these risks, exonerating the HOTEL and its employees from any liability in case of damage or injury.
4.2.9. Use the furniture, equipment, and facilities in both the room and the hotel properly, maintaining them in the condition they are found in, and will be liable for any damage or loss of the hotel’s property, even in the case of minor negligence. In case of loss or damage, the
GUEST will pay the corresponding repair or replacement costs.
4.2.10. Declare valuable items upon check-in to ensure their deposit and the coverage of the hotel's civil liability insurance.
4.2.11. Respect the authority of the hotel’s manager.
4.2.12. Allow inspection and/or monitoring of the room by hotel staff. This right will be exercised reasonably and includes the ability to enter or search the room when deemed necessary by the hotel manager.
4.2.13. Allow hotel employees and staff access to the room for routine cleaning and maintenance.
5. TERMINATION OF THE CONTRACT.
The accommodation contract will terminate in the following events:
5.1. Upon expiration of the agreed term.
5.2. Failure to comply with any of the obligations by either party, especially the failure to pay the price or fee by the
GUEST, or failure to pay for food, drinks, or other additional services charged to the room or personal account.
5.3. When, in the exclusive judgment of the HOTEL, the
GUEST's behavior or attire is disruptive to the tranquility and/or health of other guests or visitors.
5.4. If the
GUEST smokes in the room or in any other smoke-free area of the hotel, and it affects other guests, visitors, or users, subject to payment as detailed below.
Paragraph: Termination of the contract does not release the
GUEST from paying any outstanding balances.
6. EFFECTS OF TERMINATION.
6.1. Upon termination of the contract, the HOTEL may freely dispose of the room.
6.2. Upon termination of the contract, regardless of the cause of termination, the HOTEL is authorized to enter the room, create and sign an inventory of the
GUEST's belongings, and remove them to a secure deposit, without any responsibility for the hotel and at the
GUEST's expense and risk.
6.3. If the
GUEST does not pay the bill or part of it, the HOTEL may dispose of and sell the
GUEST's luggage and belongings in accordance with Article 1199 of the Commercial Code, using the proceeds to cover outstanding obligations. Any surplus, if any, will be made available to the
GUEST. In case of a deficit, the HOTEL may take legal action to recover the full amount owed.
7. MISCELLANEOUS.
7.1.
Legal nature of the contract. In accordance with Article 79 of Law 300 of 1996, the accommodation contract is a lease contract, of a commercial nature and based on adhesion.
7.2. The accommodation contract is evidenced by the hotel registration card issued by the HOTEL, accepted by the
GUEST’s signature, which confirms their adherence to the stipulations contained herein. The
GUEST expressly accepts that the net sum indicated on the invoice will have executive merit.
7.3. The HOTEL rejects and does not permit sexual tourism or the exploitation and sexual abuse of children or adolescents. The
GUEST may not bring minors under eighteen (18) years of age for sexual tourism into their room. Anyone who violates this may incur imprisonment from 5 to 10 years and a fine of 50 to 100 minimum legal monthly wages (smlmv). The penalties specified in the previous paragraph will be increased by half (1/2) when the actions involve minors under twelve (12) years of age.
7.4.
Charges for smoking in rooms. In accordance with environmental care and health standards, all rooms and general areas of the hotel are smoke-free. Smoking in the room or any other area of the hotel constitutes a serious breach of the accommodation contract, leading to its termination. The
GUEST may be removed from the HOTEL if their smoking affects other guests, visitors, or users. If the
GUEST smokes in the room, they must pay (i) the cost the HOTEL incurs to deodorize and clean the room, which is estimated at USD 150, calculated at the representative market rate on the day of payment, and (ii) the value of (2) nights at the rate corresponding to their accommodation, as the cleaning and deodorizing process will prevent the HOTEL from using the room for the next two (2) nights. If they smoke in any area of the hotel other than the room, they will pay the cost incurred by the HOTEL to disinfect, deodorize, and clean the area where they smoked, equivalent to USD 150, calculated at the representative market rate on the day of payment.
7.5. The HOTEL promotes compliance with Resolution 572 of 2005 and other regulations on the conservation of Flora and Fauna, as well as the preservation of cultural heritage and items of cultural interest, and contributes to and promotes compliance with Law 397 of 1997 and other applicable regulations.
7.6. The HOTEL rejects any form of discrimination, distinction, exclusion, restriction, or preference based on gender, race, color, national or ethnic origin, religion, political opinion, or any other reason or condition that aims to or has the effect of deteriorating, restricting, or limiting the enjoyment of fundamental rights and freedoms.
PRIVACY NOTICE. CCTV AUTHORIZATION:
The
GUEST acknowledges and agrees that, in order to ensure the safety of people, property, and hotel facilities, the hotel has a closed-circuit television (CCTV) system in common areas and corridors. Therefore, the
GUEST gives their express consent to be recorded by these devices during their stay at the hotel. The images and recordings obtained through this system will be used exclusively for security purposes, monitoring, and, if necessary, as evidence before the competent authorities in situations that require it, in strict compliance with current legislation on privacy and data protection. The hotel is committed to safeguarding the information captured by CCTV and taking the necessary measures to prevent unauthorized access, disclosure, or misuse by third parties. Staying at the hotel implies acceptance of this condition, without prejudice to the rights granted to the
GUEST under applicable regulations.
PRIVACY NOTICE. DATA AND INFORMATION USE AUTHORIZATION:
By signing this contract, the
GUEST expressly authorizes HOTEL LAS ISLAS to collect and use the information and personal data provided by the
GUEST in the Hotel Registration Card, such as name, address, identification, nationality, date of birth, email address, phone numbers (landline and mobile), personal preferences and interests, work or activity, in accordance with the hotel’s safe information processing policies and the current laws, for purposes of customer loyalty, contacting the data subject for post-stay service surveys, sending invitations, offers, promotions, service portfolio, or general information aimed at encouraging continued use of the hotel and providing the corresponding services. The
GUEST authorizes the information to be transferred, shared, and provided to HOTEL LAS ISLAS solely for the aforementioned purposes. The
GUEST, as the data subject, will have all the rights provided by law, as described in Article 8 of Law 1581 of 2012, and in particular, the right to know, access, update, rectify their personal data, revoke the granted authorization, or request the deletion of the information when applicable. The information processing policies can be consulted on the website

COMMITMENT TO THE PREVENTION OF MONEY LAUNDERING AND TERRORISM FINANCING (SARLAFT AND SAGRILAFT):
In compliance with the regulations on the prevention of money laundering and terrorism financing, the
GUEST declares that the funds used to pay for the contracted services come from legal activities. They also agree to provide the required information to comply with the provisions of the Money Laundering Risk Management System (SARLAFT) and the Integral Money Laundering and Terrorism Financing Risk Self-Control and Management System (SAGRILAFT). The hotel may request additional documentation, monitor transactions, and report any suspicious operations to the competent authorities. If the required information is not provided or if there are indications of illicit activities, the hotel reserves the right to cancel the reservation or terminate the contract without prior notice or compensation. All collected information will be treated confidentially and used exclusively for risk prevention purposes, in compliance with current regulations.
MINORS:
"Infants" are considered those under 2 years of age, and "Children" are those aged between 2 and 11 years on the date of check-in. Anyone aged 12 or older is considered an adult and will be charged as such.
For minors (under 18 years old): If a minor is traveling with one of their parents, for registration purposes at the hotel, a valid ID, passport, and/or civil registry must be presented at reception. If the minor is not traveling with their parents, a copy of the birth certificate showing the relationship, along with a copy of the parents' ID and an authorization form signed and notarized by both parents, is required.
The minor’s hotel entry permit does not substitute the exit permission from the country, which must be processed according to the immigration authority requirements of each country.
Note 1: If the individuals with parental authority over the minors are not their parents, the minor’s entry authorization form must be signed and notarized by those with parental authority, and an authentic copy of the document certifying this must be attached.
Note 2: If the
GUEST does not present any of the required documents, the hotel reserves the right to deny entry to the person(s) who do not have the complete documents and will notify the relevant authorities. Consumption and distribution of alcohol is prohibited for minors in all hotels, in accordance with Article 1 of Law 124/94 and other current regulations.
OVERSALE:
In the event of an overbooking situation, the hotel is free to re-accommodate customers at other hotels with similar characteristics.
REFUNDS:
In case of a refund request, it will be processed to the credit account of the invoice holder. For credit card payments, the refund will be processed through a reversal directly with the issuing bank to the same card used for the payment.
The rates do not include: non-specified expenses in the program, telephone calls, laundry service, medical assistance, medications, and charges explicitly not mentioned.
EXCEPTIONS:
No penalties apply in case of force majeure, fortuitous events, or incapacity of the reservation holder or a first-degree family member. The exemption request must be accompanied by the corresponding supporting documents and submitted within 15 calendar days from the initial travel date via email.
PREVENTION OF EXPLOITATION, PORNOGRAPHY, AND SEXUAL TOURISM OF MINORS:
In compliance with Law 679 of 2001, Law 1336 of 2009, and other regulations, HOTEL LAS ISLAS warns tourists that the exploitation and sexual abuse of minors in the country are considered crimes and are therefore punishable by law. In accordance with Decree 3840 of 2009, the hotel has adopted a "Code of Conduct" model that promotes prevention policies and prevents the sexual exploitation of children and adolescents in tourism activities.
I declare that I have been informed that HOTEL LAS ISLAS has registered the Personal Data Protection and Processing Policies with the Superintendence of Industry and Commerce, which I can consult at any time, and these policies comprehensively contain my rights and obligations as the data subject, as provided in the Constitution of Colombia, Law 1581 of 2012, Decree 1377 of 2013, and all legal and regulatory provisions that protect me.
