ACCOMMODATION CONTRACT UT HOTEL LAS ISLAS
1. OBJECT. By virtue of this contract UT HOTEL LAS ISLAS - NIT 901115948, hereinafter HOTEL LAS ISLAS or THE HOTEL, will provide accommodation to the GUEST in the room and its accessories, in exchange for a price, under the conditions noted on the Hotel Registration Card and/or in the reservation. In no case may the term exceed 30 consecutive days. 1.1. The room will be the one indicated on the Hotel Registration Card. The HOTEL may make a change of room if the guest accepts it and it is a room of equal or better conditions, or in the event of a fortuitous event or force majeure. 1.2. The check- in time is from 3:00 p.m. (3:00 p.m.) on the day of arrival and the check-out time is Check-out is until 1:00 PM (1:00 PM) on the day of departure. The time period between these times corresponds to the hotel's daily schedule. Early check-in or late check-out will be subject to availability and the GUEST must pay the corresponding amount. 1.3. Accommodation will be provided regardless of the time the GUEST actually stays in the room. Partial use will result in payment of the full rate. 1.4. The provision of the services covered by the contract and any complementary services offered by the hotel will be subject to availability and to the schedules, shifts, or physical stock of supplies, goods, facilities, or spaces required for such services.
2. PRICE. 2.1. The price of this contract corresponds to the nightly fee that the GUEST agrees to pay, which amounts to the amount indicated on the Hotel Registration Card and corresponds to the reservation made, all of which will be described on the corresponding invoice, unless the reservation was made and paid for through a travel agency, in which case the rate will be the one agreed directly with the agency. 2.2 The GUEST must also pay all charges for food, beverages, laundry, and in general, any other charges incurred during their stay and which they decide to charge to their account. 2.3 . The GUEST declares that they have been informed of the rates, fees, and general room prices per night. 2.4 . Failure to make the agreed payment will result in late payment interest being charged to the GUEST at the maximum rate permitted.
3. CUSTODY OF MONEY AND VALUABLES . Valuables such as jewelry, cameras, money, computers, cell phones, must be reported and declared at Reception at the time of check-in to the hotel, so that they can be deposited with HOTEL LAS ISLAS, if the GUEST voluntarily so requests. For this purpose, HOTEL LAS ISLAS has a hotel extracontractual civil liability policy. In the event that the GUEST does not make such a declaration and does not deliver the goods in deposit, they will exclusively assume the care of their valuables, including jewelry, computer equipment, cell phones, cameras, money, that remain in the room or service areas of the HOTEL, since in this case the HOTEL does not assume any responsibility in case of loss or damage.
4. OBLIGATIONS . 4.1.- OF THE HOTEL . 4.1.1. Provide the service covered by the contract. 4.1.2 . Attend to, receive, process and respond to suggestions, complaints or claims submitted by the guest. 4.1.3. Safeguard the money and valuables that the guest has delivered under receipt for safekeeping, in accordance with Article 1195 of the Commercial Code. 4.1.4 .- Any other obligations established by law. 4.2.- OBLIGATIONS OF THE GUEST . 4.2.1 .- Identify yourself to register at the HOTEL with a suitable identity document, presenting your citizenship card if you are Colombian or your passport or applicable document in the case of foreigners. For minors, a valid identification document must be presented. 4.2.2 .- Pay the value of the lodging plus the corresponding taxes. 4.2.3.- Pay the value of all consumption and charges made to your account. 4.2.4.- Observe decent conduct and dress appropriately. 4.2.5.- Respond, even in the case of slight negligence, to your obligations and those of your companions or guests. 4.2.6.- Register at the hotel reception all companions or guests of the GUEST who go to your room and pay the corresponding fee or value for each of them. 4.2.7.- Respect the number of people per room. 4.2.8.- THE GUEST acknowledges that the practice of sports, physical exercise, driving ships or vehicles, use of instruments and, in general, any activity that involves risk or that may be considered a dangerous activity, will be his or her decision, under his or her exclusive responsibility and implies that the GUEST has the skills and knowledge that allows him or her to assume said risks, exonerating the HOTEL and its officials or employees of any responsibility in the event that he or she suffers any damage or injury. 4.2.9.- Use the furniture, fixtures, equipment and, in general, the facilities of both the room and the HOTEL, in an appropriate manner, preserving them in the condition in which they are found and therefore will be responsible for any damage or loss of the elements and property of the HOTEL, even for slight negligence. In the event of total or partial loss or damage to the HOTEL's property due to a cause attributable to the GUEST or his companions, the GUEST must pay the corresponding price for its repair or replacement, as the case may be. 4.2.10.- Declare at the time of check-in any valuables that are his/her property, in order to guarantee the deposit of the same and the coverage of the hotel's non-contractual civil liability policy. 4.2.11.- Respect the authority of the HOTEL Manager 4.2.12. - Allow the right of inspection and/or surveillance of the room by HOTEL officials. This right will be exercised reasonably and includes the right to enter or search the room when, in the judgment of the Hotel Manager, it is necessary. 4.2.13. - Allow hotel employees and staff access for routine work and room cleaning.
5. TERMINATION OF THE CONTRACT. The accommodation contract will terminate in the following events: 5.1 - By expiration of the agreed term. 5.2 - By breach of any of the obligations of the parties and specifically by non-payment of the price or fee charged by the GUEST or by non-payment of food and beverages or other complementary services that the GUEST has charged to the room or to his/her personal account. 5.3 - In events in which, in the sole judgment of the HOTEL, the behavior or attire of the GUEST threatens the tranquility and/or health of other guests or visitors to the HOTEL. 5.4 - By smoking in the room or in any other smoke-free area of the hotel, when other guests, visitors or users are affected and without prejudice to the payment that must be made under the terms established below. Paragraph: The termination of the contract does not exonerate or release the GUEST from the payment of outstanding balances.
6. EFFECTS OF TERMINATION. 6.1.- Upon termination of the contract, the HOTEL may freely dispose of the room. 6.2.- Upon termination of the contract and regardless of the cause for termination, the HOTEL is authorized to enter the room, prepare and sign an inventory of the guest's belongings and luggage, and remove them from the room to place them in a secure and adequate deposit, without liability on the part of the HOTEL and at the expense and risk of the GUEST. 6.3.- If the GUEST does not pay the account or part of it, the HOTEL may dispose of and sell the GUEST's luggage and belongings under the terms of Article 1199 of the Commercial Code, to cover outstanding obligations with its proceeds. Any surplus, if any, will be made available to the GUEST. In the event of a deficit, the HOTEL may initiate the corresponding actions to obtain full payment of the amount owed.
7. MISCELLANEOUS. 7.1.- Legal nature of the contract. In accordance with article 79 of law 300 of 1996, the lodging contract is a lease contract, of a commercial and adhesion nature . 7.2.- The lodging contract is proven by the hotel registration card issued by the HOTEL, accepted by the signature of the GUEST, which states that he adheres to the stipulations contemplated herein. THE GUEST expressly accepts that the liquid sum of money stated on the invoice will provide executive merit. 7.3.- The HOTEL rejects and does not allow sexual tourism nor does it allow the sexual exploitation or abuse of girls, boys or adolescents. The GUEST may not enter his room minors under eighteen (18) years of age for sexual tourism and whoever does so may incur a prison sentence of 5 to 10 years and a fine of 50 to 100 smlmv. The penalties indicated in the previous paragraph will be increased by up to half (1/2) when the conduct is carried out with minors under twelve (12) years of age. 7.4.- Charges for smoking in the rooms. Being consistent with the care of the environment and health, all rooms and in general all areas of the hotel are smoke-free. Smoking in the room or in any other space of the hotel constitutes a serious breach of the accommodation contract that gives rise to its termination and may be removed from the HOTEL if it has affected other guests, visitors or users. If the GUEST smokes in the room, for each day he/she does so, he/she must pay (i) the cost that the HOTEL must incur to deodorize and clean the room, which is estimated at an amount equivalent to USD 150, settled at the representative market rate on the day of payment, and ( ii ) the value of (2) nights at the rate corresponding to his/her accommodation, since the cleaning and deodorization process implies that the HOTEL cannot use the room for the following two (2) nights. If he/she smokes in any area of the hotel other than the room, he/she must pay the cost that the HOTEL must incur to disinfect, deodorize and clean the area in which he/she smoked, which is equivalent to USD 150, settled at the representative market rate on the day of payment. 7.5.- The HOTEL promotes compliance with Resolution 572 of 2005 and other regulations for the conservation of flora and fauna, as well as the conservation of cultural heritage and assets of cultural interest and contributes to and promotes compliance with Law 397 of 1997 and other applicable regulations. 7.6.- The HOTEL rejects any form of discrimination, distinction, exclusion, restriction or preference based on gender, race, color, national or ethnic origin, religion, political opinion or any other reason or condition that has the purpose or has the effect of impairing, restricting or limiting the full enjoyment of fundamental rights and freedoms.
PRIVACY NOTICE. VIDEO SURVEILLANCE AUTHORIZATION: The guest acknowledges and accepts that, in order to guarantee the safety of people, property, and hotel facilities, the hotel has a closed-circuit television (CCTV) system in common areas and hallways. By virtue of this, the guest expressly consents to be recorded by such devices during their stay at the hotel. Images and recordings obtained through this system will be used exclusively for security and monitoring purposes and, if necessary, as evidence before the competent authorities in situations that require it, in strict compliance with current legislation regarding privacy and personal data protection.
The hotel undertakes to safeguard the information captured by CCTV and to adopt the necessary measures to prevent its access, disclosure, or misuse by unauthorized third parties. Your stay at the hotel implies acceptance of this condition, without prejudice to your rights under applicable regulations.
PRIVACY NOTICE. AUTHORIZATION FOR THE USE OF DATA AND INFORMATION : By signing this contract, the GUEST expressly authorizes HOTEL LAS ISLAS to collect and use the information and personal data provided by the GUEST on the Accommodation Registration Card, such as name, address, identification, nationality, date of birth, email address, landline and mobile or cell phone number, personal preferences and interests, work or activity, in accordance with the secure information processing policies established by the Hotel itself and by current laws, for the purpose of carrying out loyalty activities and contacting the owner of the information to send them service surveys after each stay that allow for the rating of the service provided, and to communicate invitations, offers, promotions, service portfolios, or general information that is aimed at encouraging them to continue using the Hotel and to offer the corresponding services. The GUEST authorizes the information to be transferred, transmitted, shared, and provided to HOTEL LAS ISLAS. exclusively for the purposes described above. The GUEST, as the owner of the personal data, shall enjoy all the rights under the law, as expressly described in Article 8 of Law 1581 of 2012. In particular, they shall have the right at all times to know, access, update, and rectify their personal data, revoke the authorization granted, or request the deletion of information when appropriate. COMMITMENT TO THE PREVENTION OF MONEY LAUNDERING AND TERRORISM FINANCING (SARLAFT AND SAGRILAFT): In compliance with regulations on the prevention of money laundering and terrorism financing, the guest declares that the funds used to pay for the contracted services come from lawful activities. Furthermore, the guest agrees to provide the information required to comply with the provisions of the Money Laundering and Terrorism Financing Risk Management System (SARLAFT) and the Self-Control and Comprehensive Risk Management System for Money Laundering and Terrorism Financing (SAGRILAFT). The hotel may request additional documentation, monitor transactions, and report any suspicious transactions to the competent authorities. In the event of refusal to provide the required information or if indications of illegal activities are identified, the hotel reserves the right to cancel the reservation or terminate the contract without prior notice or right to compensation. All information collected will be treated confidentially and used exclusively for risk prevention purposes, in compliance with current regulations.
MINORS : Children under 2 years of age are considered “Infants” and children are considered children between 2 and 11 years of age on the date of check-in at the hotel. Children over 12 years of age are considered adults and will be charged as such. Minors (under 18 years of age): If a minor is traveling with one of their parents in the reservation, in order to check in at the Hotel, they must present their current identity card, valid passport and/or civil registration document at the Hotel reception. If the minor is NOT TRAVELING WITH THEIR PARENTS, they are required to present a copy of their birth certificate proving the relationship, a copy of their parents’ citizenship card, and the authorization form signed and authenticated by both parents. The minor's entry permit to the hotel does not replace the exit permit from the country, and vice versa, which must be processed in accordance with the requirements of the immigration authorities of each country. Note 1: If the persons who have parental authority over the minors are not their parents, the minor's entry authorization form must be signed and authenticated by the persons who have parental authority, and an authenticated copy of the document certifying this must also be attached. Note 2: If the Client does not present any of the documents indicated here, the Hotel reserves the right to refuse entry to the person or persons of the group who do not present the complete documents and will notify the competent authorities. The consumption and distribution of alcohol is prohibited for minors in all hotels, Article 1 Law 124/94 and other current regulations.
OVERBOOKING: In the event of hotel overbooking, the hotel is free to relocate guests to other hotels with similar characteristics.
REFUNDS: If a refund is requested, the refund will be issued to the creditor account of the invoice holder. For credit card payments, the refund will be processed through a reversal directly with the franchise to the same card used for payment. Rates do not include: Expenses not specified in the program, telephone calls, laundry service, medical assistance, medications, and any charges not expressly specified. EXCEPTIONS: Penalties do not apply in the event of force majeure, unforeseen circumstances, or incapacity of the reservation holder or a first-degree blood relative. The exemption request must be accompanied by the corresponding supporting document(s) and submitted within 15 calendar days from the initial date of the trip, via email.
PREVENTION OF EXPLOITATION, PORNOGRAPHY AND SEX TOURISM OF MINORS: In compliance with the provisions of Law 679 of 2001, Law 1336 of 2009, and other regulations,
HOTEL LAS ISLAS warns tourists that the exploitation and sexual abuse of minors in the country are considered crimes and therefore are criminally punishable. By virtue of Decree 3840 of 2009, and, has adopted a "Code of Conduct" model, which promotes prevention policies and avoids the sexual use and exploitation of children and adolescents in tourism activities.
I declare that I have been informed that HOTEL LAS ISLAS has registered the Policies for the Protection and Processing of Personal Data with the Superintendency of Industry and Commerce, which I can consult at any time, and these contain in a broad and sufficient manner my rights and obligations as the owner of the data, those that are also provided for in the Political Constitution of Colombia, Law 1581 of 2012, Decree 1377 of 2013 and each of the legal and regulatory provisions that protect and protect me.
